Terms of Service

These Legal Terms are a binding agreement between you and Vítek Bordovský, IČO: 24535249, based in the Czech Republic, email support@spades-clubs.com (referred to as "we", "us", or "our").

We operate the Spades & Clubs: Cards Game app (the "App") and the website spades-clubs.com, together with any related content and services (collectively, the "Services"). The game is free to play. Spades+ is an optional paid subscription (section 9).

By downloading or using the Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, do not use the Services.

1. Minors

If you are under 15 — the age of digital consent in the Czech Republic — a parent or guardian must read and agree to these Legal Terms on your behalf and supervise your use of the Services, including any purchase.

2. Changes to these Legal Terms

We may change these Legal Terms where there is a reasonable need. If a change is material, we will give you reasonable advance notice in the App. Continued use after a change takes effect means you accept the updated terms. The date at the top shows the current version.

3. Our Services

The App lets you play the card games Bus and Rain against bots or against other players, in turn-based online matches. Using the App requires an account, created by signing in with Apple. Once you are signed in you can keep playing against bots with no internet connection; those games are saved to your account when you are next online.

We may change, add or remove features, modes and content, and may temporarily close the Services or a mode for maintenance. If a change removes something you paid for with Spades+ for the current period, section 9 applies.

The Services are operated from the Czech Republic. If you use them from elsewhere, you are responsible for complying with local law.

4. Intellectual Property

We own or licence all intellectual property rights in the Services, including source code, databases, functionality, software, designs, audio, artwork, text, and graphics (the "Content"), and the "Spades & Clubs" name, logo, and other trademarks (the "Marks").

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to install and use the App on an Apple device you own or control, for your personal, non-commercial entertainment, as permitted by the Apple Media Services Terms.

No part of the Services and no Content or Marks may be copied, reproduced, or exploited for any commercial purpose without our prior written permission.

5. Your Representations

By using the Services, you represent and warrant that:

• Any information you provide is accurate and you will keep it up to date.
• You have the legal capacity to agree to these Legal Terms.
• You are not under 15, or if you are, your parent or guardian has agreed on your behalf.
• You will not access the Services by automated or non-human means, or use them for any unlawful purpose.
• You are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.

6. Your Account

You are responsible for activity that takes place through your account and for keeping your device secure. Your display name is visible to other players. Do not share your account or transfer it to anyone else. You can delete your account at any time in the App (Profile → Delete Account); deleting it does not cancel a Spades+ subscription (section 9).

7. Rules for players and content

You agree not to:

• Post or send anything offensive or hateful, harass another player, post spam or advertising, or share someone's personal information.
• Post or send anything illegal, including threats to anyone's life or safety, sexual content involving minors, or terrorist content.
• Impersonate others, or use a display name that is misleading, offensive, or infringes someone's rights.
• Cheat, exploit bugs, or use bots, scripts, or any unauthorised automation to gain an advantage in matches.
• Circumvent, disable, or interfere with security-related features of the Services.
• Copy, adapt, decompile, reverse engineer, or disassemble any part of the Services, except to the extent this restriction is prohibited by law.
• Systematically retrieve data from the Services to build a collection or database without our written permission.
• Upload or transmit any virus, malware, or material designed to disrupt the Services.
• Use the Services for any commercial purpose we have not approved.

8. Your content, reports and moderation

Your content. Content you create that other players can see is: your display name; ideas you post on the ideas board, with their photos; your comments; which ideas you like; your moves in a match; and the preset messages you send in a match. Support messages and bug reports, with their photos, are seen only by our team. Private nicknames, colours, emoji and labels you give friends, saved rule presets and pinned matches are seen only by you. You keep the rights to your content. You grant us a non-exclusive, royalty-free licence to store it and to show it to other players in the Services for as long as it is there. You confirm your content is your own and does not break these Legal Terms or anyone's rights.

Automatic word filter. The Services automatically refuse a display name, idea or comment that contains words on our blocked list, and ideas and comments that contain links. Nothing refused is published; you see a message and can rephrase.

Reporting. You can report an idea or comment (press and hold it → Report), a player (the flag on their profile, on a friend request, or press and hold a match card → Report player). Our team looks at every report and decides within 24 hours; anything that may be illegal is handled at once. We tell whoever reported it what we decided, in their Support chat.

What we may do. If content breaks these Legal Terms we may remove it, ask you to change your display name, block an IP address used for abuse, or suspend or close an account (section 13). When we remove your content, we tell you in your Support chat what we removed, which rule it broke, and that a person decided.

Disagreeing. If you think a decision is wrong, reply in your Support chat. Someone other than the person who decided looks at it again where possible, and we answer within 7 days. You can also turn to the courts or the authorities; see sections 15 and 16.

Blocking. You can block any player — from their profile, a friend request or a match card. While either of you has blocked the other, neither can start a match with or send a friend request to the other, and you no longer see their comments.

9. Spades+

What it is. Spades+ is an optional, auto-renewing subscription, offered weekly, monthly or yearly. The price for your country is shown in the App before you buy. It adds extras — for example more open matches, more saved rule presets and pinned matches, private nicknames and styles for friends, card backs, app icons, table designs, a supporter badge and frame, your rating story, a #1 rival, and early access to new features. The current list is in the App. Spades+ does not change how a match is played or won, and the game stays free without it.

Payment and renewal. Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically for the same period unless you turn auto-renewal off at least 24 hours before the end of the current period; your Apple ID is charged within the 24 hours before the period ends. Manage or cancel it in your Apple ID settings (Settings → your name → Subscriptions). After you cancel, Spades+ stays active until the end of the period you paid for.

Refunds. Purchases are made through Apple, and refunds are handled by Apple under its rules (reportaproblem.apple.com). Your rights as a consumer are not affected.

When Spades+ ends. The extras stop and the free limits apply again. Your friends' private nicknames and styles, your saved rule presets and your pins are kept, and come back if you subscribe again; meanwhile only the free number of them is used. Supporter card backs, app icons and table designs switch back to the free ones. Matches already open continue; new ones are limited to the free number of open matches.

Changes. We may change what Spades+ includes. If we remove something significant during a period you have paid for, you may ask Apple for a refund under its rules, and we will help where we can.

Deleting your account does not cancel Spades+ — cancel it in your Apple ID settings first.

10. Privacy

Our Privacy Policy explains how we handle your personal data. Your account, gameplay and support data is stored in the European Union; some processing takes place in the United States, under the safeguards described in section 6 of the Privacy Policy.

11. Apple App Store Terms

You obtain the App through the Apple App Store. You and we acknowledge that:

• These Legal Terms are between you and us only, not with Apple, and we — not Apple — are solely responsible for the App and its content.
• We are solely responsible for providing maintenance and support for the App. Apple has no obligation to do so.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
• You must comply with applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Legal Terms and, once you accept them, may enforce them against you.

13. Term and Termination

These Legal Terms remain in effect while you use the Services. We may suspend or close your account if you seriously or repeatedly break these Legal Terms or the law, or to protect other players or the Services; we will tell you why, unless the law prevents it. You may stop using the Services and delete your account at any time in the App.

14. Governing Law

These Legal Terms and any dispute arising from them are governed by the law of the Czech Republic.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the Czech Republic or in your country of residence.

15. Disputes and Out-of-Court Resolution

If you have a problem with the Services, please contact us first at support@spades-clubs.com so we can try to resolve it.

If you are a consumer, you have the right to an out-of-court settlement. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), adr.coi.cz. You are not obliged to use it.

16. Disclaimer

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Legal Terms limits or excludes your mandatory rights as a consumer under Czech law, including your rights regarding the conformity of digital content and digital services.

17. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data, profits, or goodwill, arising from your use of the Services.

Nothing in these Legal Terms excludes or limits our liability for death or personal injury caused by our negligence, for damage caused intentionally or by gross negligence, for a breach of your mandatory consumer rights, or for anything else that cannot be excluded or limited under Czech law.

18. General

If any part of these Legal Terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right, we have not waived it. These Legal Terms and our Privacy Policy are the whole agreement between you and us about the Services. We may transfer our rights and obligations to someone who takes over the Services, provided your rights are not reduced; you may not transfer yours.
